Last I heard Santa is being held by homeland security and the united states custims & immgration service for illegally entering the nation with the intent to fly to the homes of americans and break in.
This was back in 2001 or something, so I'm not sure if he's out or not. I know immigration detainees are not allowed a defense.

Hey!  You can go after the appressed islamic elfs, but you can NOT come up north with your military! That's my home! I won't have my beautiful white snow turned red with the blood of Santa and his elves. Red just isn't as nice as white. Kill them somewhere else!
